What Law Governs Work Time in Indonesia?

Indonesia’s work time and overtime rules are mainly regulated under Indonesia’s Law No.13/2003, supported by Government Regulation No.35/2021.

These laws set rules for standard working hours, overtime limits, rest periods, and overtime compensation.

 

What Is the Standard Work Time in Indonesia?

Standard work time in Indonesia cannot exceed 40 hours per week.

This usually means:

  • Up to 7 hours per day for employees working 6 days per week
  • Up to 8 hours per day for employees working 5 days per week

Break times are not included in working hours.

Indonesia also applies additional protections for minors aged 13–15. They may only work up to 3 hours per day, and the work cannot interfere with their education.

 

How Much Is the Minimum Wage in Indonesia?

Minimum wage in Indonesia varies by province and city, so there is no single nationwide minimum wage amount.

In practice, regional minimum wages can range from over IDR 2 million per month in some areas to more than IDR 5 million per month in higher-paying regions such as Jakarta.

For part-time employees, Government Regulation No. 36/2021 also allows wages to be calculated using hourly rates based on the following formula:

Hourly minimum wage = Monthly minimum wage ÷ 126

Because regional minimum wages differ across Indonesia, hourly wage rates also vary depending on the province or city.

 

How Is Overtime Paid in Indonesia?

Employees in Indonesia qualify for overtime pay when they work more than 8 hours per day under a 5-day workweek, more than 7 hours per day under a 6-day workweek, or more than 40 hours per week.

In general, overtime in Indonesia is paid as follows:

  • First overtime hour: 1.5x the regular hourly wage
  • Additional overtime hours: 2x the regular hourly wage
  • Work on weekly rest days or public holidays: 2x to 4x the hourly wage depending on the number of hours worked

Indonesia generally limits overtime to 4 hours per day and 18 hours per week, excluding overtime worked on rest days or public holidays.

Indonesian law also requires employers to obtain written approval from the employee before overtime work begins, either through a written or electronic agreement.
