Terms & Conditions of Jibble Service

By using the Jibble mobile app, online application or website (“Service”), you agree to be bound by the following terms and conditions (“Terms of Service”).
Jibble Tech Sdn Bhd reserves the right to update and change the Terms of Service without notice.
Any new features that augments or enhances the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time here.
Violation of any of the terms below will result in the termination of your account. You agree to use the Service at your own risk.

Terms

  1. You must be of an age of majority in your state or province of residence.

  2. You must provide your full name, a valid email address or phone number and any other information requested in order to complete the sign-up process.

  3. You are responsible for maintaining the security of your account and password. Jibble Tech Sdn Bhd cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

  4. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Billing

  1. A valid credit card is required for paying accounts. Free accounts are not required to provide a credit card number.

  2. The Service is billed in advance on a monthly basis and is non-refundable. There will be no refunds or credits for partial months of service, downgrades or unused months with an open account. In order to treat everyone equally, no exceptions will be made.

  3. All fees are exclusive of any taxes, levies or duties imposed by taxing authorities and you shall be responsible for payment of all such taxes, levies or duties.

  4. If a Jibble plan is upgraded or downgraded, the new rate will be applied on the next billing cycle and will be automatically taken on the basis of the payment details provided.

  5. Downgrading the Service may cause the loss of content, features or the capacity of an Account. Jibble Tech Sdn Bhd does not accept any liability for such loss.

Billing Calculation

  1. At the beginning of every billing period, a team on the Power Plan that has entered their billing/credit card details will be charged for a payment of $10/month. This includes five Monthly Active Users (MAU). An MAU is a user that is registered as active in a specific month. This means that they have (1) Jibbled In/Out; (2) logged in to the web app; or (3) used any of the Jibble Bot or API functions.

  2. At the next billing period, the additional MAU’s for the previous month will be charged at a rate of $2/user. Read more on billing examples here.

  3. All fees are exclusive of all taxes, levies or duties imposed by taxing authorities and you shall be responsible for payment of all such taxes, levies or duties.

  4. Downgrading your Service may cause the loss of Content, features, or capacity of your Account. Jibble Tech Sdn Bhd. does not accept any liability for such loss.

Cancellation

  1. You can downgrade your account to the basic plan at any time from the subscription page in the web app (app.jibble.io).

  2. If you downgrade your account before the end of your current paid up month, your cancellation will take effect immediately and you will be not charged again.

  3. You can delete your account by contacting the Jibble team through the in-app messaging service or via e-mail: help@jibble.io. Your Account will then be scheduled for removal our team in a timely manner. You will receive a confirmation of the scheduled deletion date.

  4. All of your content will be immediately deleted from the Service upon cancellation. This information can not be recovered once your Account has been removed.

  5. Jibble Tech Sdn Bhd in its sole discretion has the right to suspend or terminate your Account and to refuse any and all current or future use of the Service or any other Jibble Tech Sdn Bhd service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account.

Modifications

  1. Jibble Tech Sdn Bhd reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof), with or without notice.

  2. Prices of all Services, including but not limited to monthly subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Jibble Site (jibble.io) or the Service itself.

  3. Jibble Tech Sdn Bhd shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Modifications

  1. If you are based within the European Union, the GDPR will be applicable to you. Under this regulation Jibble Tech Sdn Bhd act as both a data controller (who decides the purpose and manner that personal data is used) and a data processor (who processes data on behalf of the controller, which includes obtaining, recording, adapting or holding personal data).

  2. The lawful basis for collecting your data is:
    (a) You provide your consent at the point of registration for us to do so and by accepting our terms and conditions.
    (b) Processing your data in the way explained above is necessary for us to provide Jibble's services to users.
    (c) Some of that data is processed for the purposes of our legitimate interests."

  3. Jibble Tech Sdn Bhd acts as a data controller for team owners who create a team account on Jibble. If you are a team owner operating within the EU you must comply with the GDPR and this forms part of our Terms of Service. You can request a data processing agreement from us by emailing help@jibble.io.

  4. Jibble Tech Sdn Bhd acts as a data processor for the team members that join existing accounts. Jibble Tech Sdn Bhd requires consent from both team owners and team members to process their data. Furthermore, all users of the Jibble Service have individual rights to their data including to be informed, to access their data at any time, to rectify their data, to erase their data and to restrict processing. General Conditions

  1. Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis.

  2. You understand that Jibble Tech Sdn Bhd uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage and related technology required to run the Service. This is subject to the GDPR within EU countries.

  3. You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Jibble Tech Sdn Bhd, or any other Jibble Tech Sdn Bhd service.

  4. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service or access to the Service without the express written permission by Jibble Tech Sdn Bhd.

  5. We may, but have no obligation to, remove content and Accounts that are determined as unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

  6. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Jibble Tech Sdn Bhd customer, employee, member or officer will result in immediate account termination.

  7. You understand that the technical processing and transmission of the Service, including your content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

  8. Jibble Tech Sdn Bhd does not warrant that:         
    (i) the Service will meet your specific requirements;         
    (ii) the Service will be uninterrupted, timely, 100% secure or error-free;         
    (iii) the results that may be obtained from the use of the Service will be accurate or reliable;         
    (iv) the quality of any products, services, information or other material purchased or obtained by you through the Service will meet your expectations; and         
    (v) any errors in the Service will be corrected.

  9. You expressly understand and agree that Jibble Tech Sdn Bhd shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Jibble Tech Sdn Bhd has been advised of the possibility of such damages) resulting from:         
    (i) the use or the inability to use the Service;         
    (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service;
    (iii) data breaches if beyond our control and we have informed you no later than 72 hours since the breach;         
    (iv) statements or conduct of any third party on the Service;         
    (v) or any other matter relating to the service.

  10. The failure of Jibble Tech Sdn Bhd to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Jibble Tech Sdn Bhd and govern your use of the Service, superseding any prior agreements between you and Jibble Tech Sdn Bhd (including, but not limited to, any prior versions of the Terms of Service).
