What Is the Standard Work Time in Chile?

The standard working time in Chile is currently 42 hours per week for employees subject to ordinary working schedules. This is the legal maximum as of April 2026 while Chile transitions toward a 40-hour workweek. These hours must be distributed across 5 or 6 working days, with a maximum of 10 ordinary hours per day.

For minors, stricter limits apply. Adolescents who are legally allowed to work generally cannot exceed 30 hours per week, with daily limits depending on whether it is a school period or holiday period, and night work is restricted.

 

What Law Governs Work Hours in Chile?

Work hours in Chile are mainly regulated by the Chilean Labor Code, which establishes the rules for ordinary working hours, overtime, rest periods, and working day limits.

The gradual reduction of the workweek is established under Law 21.561 (40-hour workweek law), which is being implemented in stages:

  • First year: 44 hours to April 26, 2024
  • Third year: 42 hours until April 26, 2026
  • Fifth year: 40 hours until April 26, 2028

For part-time workers, Chilean law establishes that part-time working hours must not exceed 30 hours per week.

Employers in Chile are legally responsible for controlling attendance and verifying the exact hours employees work, including overtime. Companies must be able to demonstrate this through attendance records, time clocks, or electronic tracking systems, which makes having reliable and accurate time calculations especially important.

 

How Much Is the Minimum Hourly Pay in Chile?

Chile does not set an official nationwide minimum hourly wage. Instead, the minimum wage is set as a monthly salary (Ingreso Mínimo Mensual), from which an hourly value is typically calculated.

As of January 2026, the minimum monthly wage is CLP 539,000 for workers aged 18–65, and CLP 402,082 for workers under 18 or over 65.

Based on the current full-time limit of 42 hours per week, this corresponds to roughly CLP 3,000 per hour for a full-time worker. Part-time workers must receive at least the proportional equivalent of the legal monthly minimum based on their agreed working hours.

 

How Is Overtime Paid in Chile?

Overtime in Chile is paid with a surcharge over the employee’s normal hourly wage and must follow specific legal requirements. In general:

  • Overtime is paid with a 50% surcharge over the normal hourly wage (1.5× the regular hourly rate).
  • Overtime pay must be paid together with the employee’s regular salary for the same pay period.
  • If the employee’s salary is not defined or is below the minimum monthly income, overtime must be calculated using the minimum monthly wage as the base.
  • Overtime can only be agreed to meet temporary business needs and must be documented in writing.
  • Overtime is generally limited to a maximum of 2 extra hours per day.
