What Law Governs Working Time in South Africa?
Working time in South Africa is mainly regulated by the Basic Conditions of Employment Act (BCEA).
This law sets the rules for ordinary working hours, overtime limits, rest periods, and conditions for different types of employees, while allowing some variation through collective agreements or sector-specific rules.
What Is the Standard Work Time in South Africa?
The standard working time in South Africa is 45 hours per week, usually 9 hours per day in a 5-day workweek.
Employees may work overtime, but overtime is generally limited to 10 hours per week, and total working time cannot exceed 12 hours per day, including overtime.
How Much Is the Minimum Wage in South Africa?
South Africa’s national minimum wage is set under the National Minimum Wage Act, 2018 and is reviewed regularly by the Department of Employment and Labour.
From 1 March 2026, the national minimum wage is R30.23 per ordinary hour worked.
This change was published in South African Government Gazette No. 54075 (Notice R.7083) on 3 February 2026 and becomes legally binding on the effective date. This rate applies across industries and includes general workers, farm workers, and domestic workers, all of whom are now entitled to at least R30.23 per hour.
There are a few specialized categories with different rates in the same amendment:
- Workers employed under the Expanded Public Works Programme (EPWP) are guaranteed R16.62 per hour.
- Employees in approved learnership programs receive weekly allowances that vary depending on their credential level and training category.
How Is Overtime Paid in South Africa?
Overtime in South Africa is generally paid at 1.5x (150%) of the employee’s normal hourly wage. Work performed on Sundays or public holidays is typically paid at 2x (200%) of the normal hourly wage, unless time off in lieu is agreed.
Overtime must be agreed between the employer and employee and it is limited to 3 hours per day or 10 hours per week. Any hours worked beyond the employee’s normal agreed working hours (typically up to 45 hours per week under South African law) are considered overtime and must be compensated accordingly.
