How Much Is Overtime Pay in Chile?

As of April 2026, Chile’s legal working schedule is 42 hours per week. Hours worked beyond that schedule are paid at 1.5x the employee’s regular hourly wage, which equals a 50% surcharge on top of the normal hourly rate.

In some cases, employers and employees may also agree to compensate overtime with additional vacation time instead of overtime pay. Employees receive one and a half hours of vacation for each overtime hour worked.

 

Is There an Overtime Limit in Chile?

Yes. Chilean Labor Code (Código del Trabajo) generally allows a maximum of 2 overtime hours per day under the standard working schedule, as long as the work does not affect the employee’s health.

Some employees working under the flexible scheduling system covered by Article 22 bis may work up to 52 hours in a week, but only in specific cases agreed through collective bargaining or union agreements.

 

Is Overtime Obligatory in Chile?

No. Under Article 32 of the Chilean Labor Code, overtime hours must be agreed upon between the employer and employee to address temporary business needs or situations.

The law also states that overtime agreements must be made in writing and can remain valid for up to three months, unless renewed again by mutual agreement.

 

Are Chilean Employers Required to Track Overtime Hours?

Yes. Under Article 33 of the Chilean Labor Code, employers must track employee attendance and working hours, including both regular and overtime hours. Employers are required to maintain an attendance book, time clock system, or authorized electronic timekeeping system.
