What Law Governs Work Hours in Mexico?

The Federal Labor Law (Ley Federal del Trabajo – LFT) regulates work hours in Mexico. It defines working time, sets daily and weekly limits, and establishes rules for shifts, overtime, and rest days.

In February 2026, Congress approved a constitutional reform to gradually reduce the standard workweek from 48 hours to 40 hours. The reform includes a transition mechanism and requires updates to the LFT within 90 days of the constitutional change taking effect.

The reduction will begin in January 2027 and continue progressively until 2030.

 

What Are the Standard Work Hours in Mexico?

As of 2026, the current legal framework still allows a maximum of 48 hours per week, depending on shift type:

  • Day shift: Up to 8 hours per day (6:00 a.m. to 8:00 p.m.)
  • Night shift: Up to 7 hours per day (8:00 p.m. to 6:00 a.m.)
  • Mixed shift: Up to 7.5 hours per day, provided night work does not exceed 3.5 hours

Employees must receive at least one rest day for every six days worked.

 

Upcoming Changes (2027–2030)

Starting January 1, 2027, the weekly limit will drop to 46 hours, with a further reduction of 2 hours each year until the 40-hour workweek is fully implemented by 2030.

The reform also:

  • Increases the weekly overtime cap from 9 to 12 hours
  • Limits triple-paid overtime to 4 hours per week, which may be worked over a maximum of 4 days
  • Prohibits salary or benefit reductions during implementation
  • Prohibits overtime for workers under 18

Until the transition begins in 2027, the 48-hour weekly standard remains in force.

 

How Much Is the Minimum Hourly Pay in Mexico?

For 2026, Mexico’s general minimum wage is MXN 315.04 per day. In the Northern Border Free Zone (ZLFN), the rate increases to MXN 440.87 per day, as confirmed by the National Minimum Wage Commission (CONASAMI)

Mexico defines the minimum wage per day, not per hour.

Based on a standard 8-hour workday, this equals approximately:

  • MXN 39.38 per hour (general minimum wage)
  • MXN 55.11 per hour (Northern Border Free Zone)

These hourly amounts come from a simple daily ÷ 8 calculation.

 

How Is Overtime Paid in Mexico?

Overtime in Mexico is paid based on how many extra hours an employee works beyond their normal schedule during the week.

  • First 9 overtime hours per week: Paid at double pay (200%) of the normal hourly wage.
  • Overtime beyond 9 hours per week: Paid at triple pay (300%) of the normal hourly wage.

Overtime is generally limited to up to 3 extra hours per day, and it can only be worked up to three times per week, except in emergencies such as accidents or serious risk to the workplace. In addition, employees under 18 years old are not allowed to work overtime or work on mandatory rest days.

Employees also have the legal right to claim unpaid overtime wages for up to one year after the work was performed.
