How Much Is Overtime Pay in Mexico?

In Mexico, overtime pay depends on the number of extra hours an employee works during the week:

  • The first 9 overtime hours per week are generally paid at double the employee’s regular hourly wage (200% of the normal rate).
  • Any overtime beyond 9 hours per week is generally paid at triple the regular hourly wage (300% of the normal rate).

 

Is There an Overtime Limit in Mexico?

Yes. Mexico’s Federal Labor Law (Ley Federal del Trabajo) sets limits on how much overtime employees can work.

Under Article 66 of the LFT:

  • Overtime cannot exceed 12 hours per week.
  • Those overtime hours may be distributed across up to 4 hours per day.
  • Overtime may only be worked on a maximum of 4 days per week.

In addition, Article 68 states that the combined total of regular and overtime hours cannot exceed 12 working hours in one day.

 

Are Mexican Employers Required to Keep Working Time Records?

Yes. Mexican employers are generally required to keep working time and attendance records under the Federal Labor Law.

Under Article 804 of the LFT, employers must preserve documents such as:

  • attendance records,
  • payroll records,
  • and salary payment receipts.

These records are important because they help prove regular working hours, overtime worked, and overtime payments.

The law also places the burden of proof on employers in disputes related to working hours. Under Article 784 of the LFT, employers may be required to prove ordinary and overtime working hours through these records. If the employer cannot provide them, the employee’s claims may be presumed true unless evidence shows otherwise.
