How Much Is Overtime Pay in Brazil?

Overtime in Brazil is usually paid at 1.5x the normal hourly wage (a 50% increase), as set by the Consolidation of Labor Laws (CLT).

Higher rates may apply if defined in a collective agreement. There are a few important variations:

  • Night work (10 PM – 5 AM) includes at least a 20% surcharge, even if it’s not overtime
  • The night hour is shorter (52 minutes 30 seconds), which increases the effective hourly rate
  • In exceptional cases (Article 61), overtime should be paid at at least 25% extra, depending on the situation.

 

Is There an Overtime Limit in Brazil?

Yes, overtime in Brazil is limited by law.

The standard working time is 8 hours per day and 44 hours per week. Any work beyond this is considered overtime.

Under Article 59 of the CLT, employees can generally work up to 2 overtime hours per day, meaning a maximum of 10 hours per day.

This must be agreed in writing or through a collective agreement.

There are exceptions under Article 61 of the CLT. In cases of force majeure or urgent work, employees may work beyond the normal overtime limits. In these situations:

  • overtime may be required without a prior agreement
  • total working time may exceed the standard limits
  • overtime must still be properly compensated (at least the normal rate, or 25% extra, depending on the case).

 

Are Brazilian Businesses Required to Track Overtime?

Yes, Brazilian businesses are required to keep records of working hours, which includes overtime.

Under Article 74 of the CLT, working hours must be recorded, and companies with more than 20 employees are required to track entry and exit times using a manual, mechanical, or electronic system.

Because overtime is defined by hours worked beyond the legal limits, it must be reflected in these records to ensure correct pay and compliance with labour law.
