What Law Governs Work Time in Peru?

Work time in Peru is primarily governed by Article 25 of the Political Constitution of Peru, which establishes the legal framework for ordinary working time and employee protections related to working schedules.

 

What Is the Standard Work Time in Peru?

Working time generally includes the period during which employees are carrying out their duties and remain available to the employer.

In Peru, the ordinary work schedule cannot exceed 8 hours per day or 48 hours per week.

For minors, stricter limits apply:

  • Ages 12 to 14: Up to 4 hours per day or 24 hours per week
  • Ages 15 to 17: Up to 6 hours per day or 36 hours per week

These limits are designed to balance work opportunities with health, education, and overall well-being.

 

How Much Is the Minimum Wage in Peru?

As of 2026, the minimum wage in Peru is PEN 1,130 per month for employees working a full ordinary schedule. This rate is known as the Remuneración Mínima Vital (RMV) and applies across most sectors in the country.

 

How Is Overtime Paid in Peru?

Peruvian labor rules apply different overtime rates depending on how many extra hours an employee works in a day:

  • First two overtime hours: Minimum 25% surcharge on top of the employee’s regular hourly rate, equal to 125% of normal pay
  • Third overtime hour onwards: Minimum 35% surcharge on top of the regular hourly rate, equal to 135% of normal pay

Employers and employees may also agree to replace overtime pay with paid time off. This arrangement must be made in writing, and the time off should be granted within the following calendar month.
