What Law Governs Work Time in Argentina?

Working time in Argentina is mainly regulated by the Employment Contract Law (Law 20.744) and the Working Hours Law (Law 11.544).

These laws set the rules for working time limits, overtime, rest periods, and general working conditions for employees.

 

What Is the Standard Work Time in Argentina?

The standard working time in Argentina generally cannot exceed 8 hours per day or 48 hours per week for most employees.

Working hours can be distributed unevenly across the week, but daily working time normally cannot exceed 9 hours. Workers are also entitled to mandatory rest periods, including 12 hours between shifts and a weekly rest period of 35 uninterrupted hours.

However, following the labor reform known as the “Ley de modernización laboral” promulgated on March 6, 2026, employers may agree on more flexible schedules in some cases. This can allow employees to work up to 12 hours in a single day, as long as the extra hours are compensated later with time off and the overall legal limits on working time are still respected.

 

How Much Is the Minimum Wage in Argentina?

In Argentina, the minimum wage is set as both:

  • an hourly rate for day laborers, and
  • a monthly rate for full-time employees.

The government updates these rates through official resolutions, and for 2026, the minimum wage is scheduled to increase monthly.

For 2026, the official minimum wage rates are:

  • January 2026: ARS 1,705 per hour / ARS 341,000 per month
  • February 2026: ARS 1,734 per hour / ARS 346,800 per month
  • March 2026: ARS 1,762 per hour / ARS 352,400 per month
  • April 2026: ARS 1,789 per hour / ARS 357,800 per month
  • May 2026: ARS 1,815 per hour / ARS 363,000 per month
  • June 2026: ARS 1,839 per hour / ARS 367,800 per month
  • July 2026: ARS 1,862 per hour / ARS 372,400 per month
  • August 2026: ARS 1,883 per hour / ARS 376,600 per month

 

How Is Overtime Paid in Argentina?

Overtime in Argentina is traditionally paid with a wage surcharge, typically 50% on regular working days and 100% on rest days or holidays.

However, following the 2026 labor reform, employers and employees may agree to compensate extra hours with time off instead of additional pay in certain cases.

Overtime is also generally capped at 3 hours per day, 30 hours per month, or 200 hours per year, except in exceptional circumstances.
