How do you calculate overtime in a California Paycheck?
Overtime in California is calculated based on the hours worked by an eligible employees.
The rate is set at 1.5x the employee’s regular rate of pay for hours worked beyond 8 hours up to 12 hours in a day, or for the first eight hours worked on the seventh consecutive workweek day.
The rate is at 2x the employee’s regular rate of pay for hours worked beyond 12 hours in a day and hours over eight hours on the seventh consecutive workweek day.
For example, if an employee’s regular rate is $20/hour, and they worked 9 hours in a day, one of those hours must be paid at $30 (1.5× rate).
How often do I get my paycheck in California?
In California, most wages must be paid at least twice a month, with paydays designated and posted in notice in advance.
Standard pay schedules dictate that:
- Wages earned between 1st–15th of the month must be paid by the 26th of the same month.
- Wages earned between 16th–end of the month must be paid by the 10th of the next month.
For other Pay Schedules (e.g., weekly, biweekly, semimonthly), wages must be paid within 7 days after the end of the pay period
Overtime Pay Must be paid by the next regular payday after it’s earned.
What are the payroll deductions in a California paycheck?
Lawful deductions from employee payroll in California include:
- Deductions required by federal or state law, including income taxes or garnishments.
- Deductions the employee has agreed to in writing, such as for insurance, medical fees, as long as they don’t reduce the employee’s actual wages.
- Deductions approved through a collective bargaining or wage agreement for health and welfare or pension payments.
