Sin embargo, <\/span><b>no reemplaza al salario m\u00ednimo<\/b><span style=\"font-weight: 400;\"> establecido por ley.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Esto significa que adem\u00e1s del salario mensual correspondiente al trabajador, los patronos est\u00e1n obligados por ley a agregar una<\/span><b> bonificaci\u00f3n incentivo de Q250<\/b><span style=\"font-weight: 400;\">, establecida en el <\/span><a href=\"https:\/\/www.congreso.gob.gt\/assets\/uploads\/info_legislativo\/decretos\/1989\/gtdcx00781989.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Decreto n\u00famero 78-89 del Congreso de la Rep\u00fablica de Guatemala<\/span><\/a><span style=\"font-weight: 400;\">.<\/span>\r\n\r\n[\/sc_fs_faq]\r\n<h2 id=\"historia\">Historia del salario m\u00ednimo en Guatemala<\/h2>\r\n<span style=\"font-weight: 400;\">El t\u00e9rmino de salario m\u00ednimo en Guatemala comenz\u00f3 a utilizarse en 1951, durante el gobierno de Jacobo \u00c1rbenz, donde se divid\u00eda entre el sueldo m\u00ednimo de la ciudad y del campo. Sin embargo, se derog\u00f3 en 1954 y se reconsider\u00f3 diez a\u00f1os despu\u00e9s.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">A partir del 2008, el Organismo Ejecutivo modific\u00f3 la fijaci\u00f3n de salarios m\u00ednimos seg\u00fan las diferentes actividades econ\u00f3micas que rigen en el pa\u00eds.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Cabe agregar que el salario m\u00ednimo en Guatemala no solo ha sido tema a nivel nacional, sino que tambi\u00e9n se ha ratificado mediante tres convenios internacionales con la Organizaci\u00f3n Internacional del Trabajo (OIT):<\/span>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Convenio N\u00b0 26: <\/b><span style=\"font-weight: 400;\">El <\/span><a href=\"https:\/\/normlex.ilo.org\/dyn\/nrmlx_es\/f?p=NORMLEXPUB:12100:0::NO:12100:P12100_INSTRUMENT_ID:312171:NO\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Convenio N\u00b0 26<\/span><\/a><span style=\"font-weight: 400;\"> sobre los m\u00e9todos para la fijaci\u00f3n de salarios m\u00ednimos, firmado en 1961.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Convenio N\u00b0 99:<\/b><span style=\"font-weight: 400;\"> El <\/span><a href=\"https:\/\/normlex.ilo.org\/dyn\/nrmlx_es\/f?p=NORMLEXPUB:12100:0::NO:12100:P12100_INSTRUMENT_ID:312244:NO\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Convenio N\u00b0 99<\/span><\/a><span style=\"font-weight: 400;\"> sobre los m\u00e9todos para la fijaci\u00f3n de salarios m\u00ednimos en la agricultura, firmado en 1961.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Convenio N\u00b0 131:<\/b><span style=\"font-weight: 400;\"> El <\/span><a href=\"https:\/\/normlex.ilo.org\/dyn\/nrmlx_es\/f?p=NORMLEXPUB:12100:0::NO:12100:P12100_INSTRUMENT_ID:312276:NO\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Convenio N\u00b0 131<\/span><\/a><span style=\"font-weight: 400;\"> sobre la fijaci\u00f3n de salarios m\u00ednimos, firmado en 1988.<\/span><\/li>\r\n<\/ul>\r\n<span style=\"font-weight: 400;\">A continuaci\u00f3n, te dejamos una tabla con los porcentajes de aumento del salario m\u00ednimo en Guatemala durante los \u00faltimos a\u00f1os:<\/span>\r\n<table class=\"dotted\" style=\"width: 100%; Sin embargo, <\/span><b>no puede ser menor del salario m\u00ednimo mensual <\/b><span style=\"font-weight: 400;\">fijado por la ley.<\/span>\r\n\r\n[\/sc_fs_faq]\r\n\r\n[sc_fs_faq html=\"true\" headline=\"h2\" img=\"\" question=\"\u00bfQui\u00e9n es responsable de hacer cumplir las leyes de salario m\u00ednimo en Guatemala?\" img_alt=\"\" css_class=\"responsable\"]\r\n\r\n<span style=\"font-weight: 400;\">La <\/span><a href=\"https:\/\/www.mintrabajo.gob.gt\/index.php\/nosotros\/inspeccion-general-de-trabajo\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Inspecci\u00f3n General de Trabajo de Guatemala<\/span><\/a><span style=\"font-weight: 400;\">, que depende del Ministerio de Trabajo y Previsi\u00f3n Social, es la encargada de realizar la inspecci\u00f3n y verificaci\u00f3n del cumplimiento del pago del salario m\u00ednimo fijado por actividad y circunscripci\u00f3n econ\u00f3mica.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">Sin embargo, la Comisi\u00f3n Nacional del Salario (CNS) es el organismo t\u00e9cnico y consultivo cuya responsabilidad es regular los tipos de salarios m\u00ednimos de los trabajadores en Guatemala. Dicha comisi\u00f3n paritaria debe ser integrada por los siguientes miembros:<\/span>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dos patronos<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dos trabajadores sindicalizados<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Un inspector de trabajo<\/span><\/li>\r\n<\/ul>\r\n<span style=\"font-weight: 400;\">Entre esta comisi\u00f3n se proponen los diferentes salarios m\u00ednimos de Guatemala, seg\u00fan circunscripci\u00f3n y actividad econ\u00f3mica.<\/span>\r\n\r\n[\/sc_fs_faq]\r\n<h2 id=\"leyes\">Cumplimiento de las leyes sobre salario m\u00ednimo en Guatemala<\/h2>\r\n<span style=\"font-weight: 400;\">Los empleadores deben cumplir con las leyes de salario m\u00ednimo de Guatemala y mantenerse al tanto de sus frecuentes cambios.
